BBS - Business Benchmarking Solutions
Sponsor - is the association, group, business or legal entity who arranges, creates or organises with BBS to develop, design and deliver a benchmarking survey opportunity to End Users.
End Users - are the clients, customers or members whom the Sponsor invites and offers the opportunity to participate in surveys arranged, created or organised by Sponsors.
BBS Created Surveys - are surveys that created by BBS and are used as 'guides' or examples to assist Sponsors to create their own survey offering. BBS Created Survey include surveys that have been created, changed or modified by BBS or on behalf of Sponsors.
Sponsor Created Surveys - are surveys that are created and designed entirely by the Sponsor. They are delivered and provided in completed form to BBS to directly create online data entry sheets. The Fully Customised Surveys do not utilise any form of Survey Templates that BBS offers.
BBS Private Portals - are portals created and provided as a direct result of a Sponsor choosing to utilise BBS tools so that End Users have a private and confidential path for entering data in the surveys tin which they participate.
Sponsor Controlled Portals - are any portals or data entry sites that are not under the direct control of BBS.
End User Data - is data entred by or on behlaf of the End User and reflects what would reasonably by considered to be private or confidential information.
Generic Data - is data that is calculated or collated as a result of data entry by a number of participants.
BBS consider ourselves to be a software company that processes data on behalf of Sponsors who wish to provide benchmarking services to third parties such as members, clients and customers (End Users).
We do not consider ourselves to be a data company. As a result we do not sell data that is obtained through End Users and Sponsors utilising our benchmarking services.
BBS recognises that both the integrity of BBS and the ongoing participation of Sponsors and End Users are totally dependant on the maintenance of strict rules about data confidentiality.
All benchmarking surveys operated under the direct control of BBS come with an assurance of confidentiality for individual End User data except where specifically excluded from the Terms and Conditions of a given survey.
The End User data entered on the BBS Private Portals will only be viewed by persons given access to the portal by the Sponsor or the End User or persons directly associated in the actual physical act of data collation for survey results (such as BBS staff members or associated companies). Unless the specified survey has documentation to specifically allow third party access, no additional access to End User data will be given.
Unless otherwise specified, Sponsors DO NOT have access to private survey data entered by End Users.
Sponsors DO have access to generic data created as a result of multiple participants in a benchmarking survey. Sponsors also have access to portal activity of the End Users (for example who has accessed portal, times, frequency etc)
We maintain confidentiality of any dealings with Sponsor organisations accept where we have specific permission to disclose information. This may be required for testimonials etc that are authorised by the Sponsor.
Sponsors receive access to the BBS Portal Activities tools and other tools that allow assessment of End User participation.
Sponsors are entitled to receive reports relating to the generic data that result from the survey that has been sponsored. There may be costs associated with compiling this information.
End Users supply information that may be considered highly confidential for the purposes of participating in surveys created by BBS. All information that an End User supplies on a BBS controlled portal is considered to be confidential and only the Confidential User can view data that has been entered.
Limited exceptions to this rule include:
- Access by BBS staff members directly associated with managing survey activity and results
- Surveys that have specifically included, in the terms of the survey, for access via other third parties
- Authorized third party service providers which perform certain services on our behalf
- Surveys that are recorded on Sponsor Controlled Portals or entry systems that are not directly controlled by BBS
Whilst data supplied directly by End Users or Sponsors is considered confidential, the generic data that is compiled from survey participation of multiple End Users is not considered to be confidential. As described in Our Philosophy, BBS does not sell data. Generic data may be supplied to the Sponsor of the survey who may deal with it as they see fit. Some generic data is also supplied in private reports for each of the individual End Users as part of the comparison that is the nature of benchmarking.
Personally Identifiable Information
BBS does not supplied any Personally Identifiable Information to any third party other than the Sposnors who are entitled to know the activity of the End User on portals. This does not include exceptions listed in other parts of this document.
Personally Identifiable Information collected, purpose and use
In compliance with the CAN-SPAM Act, we offer free opt-out mechanisms in every commercial request and email we sent to our users and, therefore, you may opt out of different types of communications using the unsubscribe link found in the footer of the emails sent or through the settings on the Site or your mobile device.
From time to time, we may collect personal data about you. For purposes of this Policy, “sensitive personal data” shall mean, including but without limitation, your racial or ethnic origin, health data, financial data like credit card or bank information and biometric information. You can rest assured that we undertake all necessary industry standard safety measures to safeguard your private information.
We may use any or all personally identifiable information collected to provide our Services. We may also use it to undertake assessments, audits, create aggregated databases, and obtain analytics and data which allows us to deliver a better Service, improve the Site and appertaining technologies of BBS.
Personally Identifiable Information release and disclosure
Notwithstanding the foregoing, we hereby reserve the right to release your information when we reasonably believe you to be in breach of our Terms and/or Policy. We will also release any and all collected information and/or personal data under the following circumstances:
- If required by applicable law;
- In response to a valid request from a law enforcement agency;
- To defend ourselves and our affiliates from legal claims by third parties and to respond to such claims and legal processes (including takedown notices and subpoenas);
- To protect the property, rights and integrity of BBS or any third party;
- To prevent or terminate any activity we may consider to be -- or which me may consider posing a risk -- of any illegal, unethical or objectionable activity;
- To provide and improve our Services, via our affiliate, subsidiary or holding companies, which may use your information.
From time to time, we may share our users' personal information to our Sponsors and/or authorized third party service providers which perform certain services on our behalf. These services may include, but will not be limited to: cloud computing, community management, customer service, analytics, user engagement, marketing, surveys and other features offered through our Site.
Our Site is hosted in Australia, and therefore is subject to applicable Australian law. If you are accessing our Service from other jurisdictions, please be advised that you are transferring your personal information to us and, thus, by using our Site, you hereby consent to that transfer of information to the Australia or to any other country in which BBS operates its facilities
If you are located in regions with laws governing data collection and use that may differ from Australian law, please take into account that we may transfer your information to a country and jurisdiction that does not have the data protection laws as stringent as those in your jurisdiction.
Owner rights and revocation of consent
In compliance with the Information Privacy Act of 2009 and following the essence of the European Union Data Protection Directive, any user of our Site and Services has the right to make a request to us in order to uphold his rights to:
- Access his personal data;
- Rectify his personal data when inaccurate or incomplete;
- Cancel his personal data;
- Object with legitimate reasons the process of his personal data; and/or
- Revoke his consent for the process of his personal data at any moment, in order to stop its use.
The enforcement and upholding of your ARCO rights should be requested in writing to us and must include, at the least, the following information: (i) your name, address and e-mail address in order to notify you of the response to your request; (ii) documents establishing your identity; and (iii) a clear and concise description of the personal data with regard to which you seek to uphold any of the abovementioned rights (when rectification is requested, modifications to be made should be specified and documentation provided to back up its request).
For the exercise of your previous rights, Business Benchmarking Solutions hereby provides its users with the following e-mail address: firstname.lastname@example.org. Upon your request to us, and after proper review, we may edit, deactivate and/or delete your personal data and other information from our active databases. Please be advised that we may not be able to delete all of your personal data from some of our secure databases and, in such case, we will make the data permanently inaccessible to any third parties. You may also be able to edit the personal information we store about you, by going to your account settings in the Site.

Our Site and Services may implement links to the websites of our commercial partners and other third parties. If you choose to visit such websites, please take into account that we shall not be responsible for the practices employed by such websites linked to or from our Services, including the information or content contained thereinto.
