This Privacy Policy explains how Business Benchmarking Solutions (BBS) handles your personal information and data. We value your trust when using our services so we have attempted to present this policy in clear, plain language instead of legal terminology.
This Privacy Policy applies to all the products, services, portals and websites delivered by, and under the direct control of, Business Benchmarking Solutions.

Our Philosophy
Business Benchmarking Solutions (BBS) provides services and capability for groups (Sponsors) to deliver benchmarking and/ or survey services (Services) to their members (End Users).
In order to effectively provide this service, it is necessary to collect participants personal information, business information and other specific survey data that may be considered to be confidential.
Information is collected on a series of confidential and secure portals that are set up for each Sponsor group.
Our Values
We consider ourselves to be a service company, we do not consider ourselves to be a data company.
As a result, BBS :
- does not sell or share confidential data that is obtained through provision of services to Sponsors and/or End Users
- does not claim ownership of information that is entered or uploaded
- does provides user and data security platforms that are at, or above, industry standards
- treats all End User data in an appropriate manner and with the respect that you would reasonably expect
- has strict rules and systems controlling who can access confidential data and personal information
- has comprehensive Terms of Use policies for each portal that clearly outlines how data is treated by BBS and associated policies
BBS recognizes that both the integrity of our company and the ongoing long-term relationship of Sponsors and End Users are totally dependent on the maintenance of strict rules about data confidentiality.
All benchmarking surveys operated under the direct control of BBS come with an assurance of confidentiality for individual End User data with limited exceptions clearly outlined in our Terms of Use.
Sponsors
Sponsor - is an association, group, business or legal entity who arranges, creates or organizes with BBS to develop, design and deliver a benchmarking and survey opportunities to End Users.
It is the right of the Sponsor to invite members, associates or clients to participate in services offered by BBS.
Sponsors are responsible for the design, creation and content of surveys, and are the conduit between BBS and the End User.
- In some circumstances it is appropriate (in most circumstances) that Sponsors are given access to the content uploaded survey data, reports on activity of users, and outcomes of analysis performed on data (Generic Data).
- Under other circumstances, selected surveys and portals may specifically exclude Sponsor access to End User data.
The status of the Sponsor and their level of access for each portal are clearly outlined in the Terms of Use for each specific portal that End Users must view and accept prior to participation.
If Sponsors have access to private and confidential data, it is reasonably expected that Sponsors also have Privacy Policies that clearly outline how your confidential and private information will be handled.
End Users
End Users supply information that may be considered highly confidential for the purposes of participating in surveys created and delivered by BBS and the Sponsor. All information that an End User supplies on a BBS controlled portal is considered to be confidential and only the Confidential User (End Users representative) can view data that has been entered (with limited exceptions specified in the Terms of Use)
Users are made aware that the following general exceptions apply to viewing and accessing EUD
- Access by BBS essential staff members directly associated with managing activity and operation of the Services
- Authorized third party service providers which deliver certain services on behalf of BBS
- When the Terms of Use of a specific portal, or survey, specifically preclude Sponsor access to EUD
Furthermore, all or any of the EUD may be released if:
- If required by applicable law;
- In response to a valid request from a law enforcement agency;
- To defend ourselves and our affiliates from legal claims by third parties and to respond to such claims and legal processes (including takedown notices and subpoenas);
- To protect the property, rights and integrity of BBS or any third party;
- To prevent or terminate any activity we may consider to be, or which we consider poses a risk, of any illegal, unethical or objectionable activity
Generic Data
Generic Data - is data output, insights or market intelligence that is calculated, analyzed, collated or gained as a result of End User Data entry by a number of participants. This is in line with the general concept of Benchmarking.
Generic Data is created and made available at the request of the Sponsor, who also has total discretion to choose what Generic Data is to be used in End User reports or otherwise made available to End Users.
Personally Identifiable Information (PII)
BBS does not supply any Personally Identifiable Information to any third party other than under specific exceptions clearly identified in the Terms of Use.
PII - collected, purpose and use
In compliance with the CAN-SPAM Act 2003 and/or Spam Act 2003, we offer free opt-out mechanisms in every commercial request and email we sent to users and, therefore, you may opt out of different types of communications using the Unsubscribe link found in the footer of the emails sent or through the settings on the Site or your mobile device.
From time to time, personal data maybe collected about you in order to provide to you a better Service. You can be rest assured that we undertake all necessary industry standard safety measures to safeguard your private information.
We may also use it to undertake assessments, audits, create aggregated databases, and obtain analytics and data which allows us to deliver a better Service, improve the Site and appertaining technologies of BBS.
PII - release and disclosure
Notwithstanding the foregoing, we hereby reserve the right to release your information when we reasonably believe you to be in breach of our Terms and/or Policy. We will also release any and all collected information and/or personal data under the following circumstances:
- If required by applicable law;
- In response to a valid request from a law enforcement agency;
- To defend ourselves and our affiliates from legal claims by third parties and to respond to such claims and legal processes (including takedown notices and subpoenas);
- To protect the property, rights and integrity of BBS or any third party;
- To prevent or terminate any activity we may consider to be -- or which me may consider posing a risk -- of any illegal, unethical or objectionable activity;
- To provide and improve our Services, via our affiliate, subsidiary or holding companies, which may use your information.
Owner rights and revocation of consent
In compliance with the Information Privacy Act of 2009 and following the essence of the European Union General Data Protection Regulation (GDPR), any user of our Sites and Services has the right to make a request to us in order to uphold his/her rights to:
- Access his/her personal data;
- Rectify his/her personal data when inaccurate or incomplete;
- Cancel his/her personal data;
- Object with legitimate reasons the process of his/her personal data; and/or
- Revoke his consent for the process of his/her personal data at any moment, in order to stop its use.
The enforcement and upholding of your ARCO rights should be requested in writing to us and must include, at the least, the following information: (i) your name, address and e-mail address in order to notify you of the response to your request; (ii) documents establishing your identity; and (iii) a clear and concise description of the personal data with regard to which you seek to uphold any of the abovementioned rights (when rectification is requested, modifications to be made should be specified and documentation provided to back up its request).
For the exercise of your previous rights, BBS hereby provides its users with the following e-mail address: admin@benchmarkingsolutions.net. Upon your request to us, and after proper review, we may edit, deactivate and/or delete your personal data and other information from our active databases. Please be advised that we may not be able to delete all of your personal data from some of our secure databases and, in such cases, we will make the data permanently inaccessible to any third parties. You are able to edit the personal information we store about you, by going to your account settings located in the My Account section of the BBS the Sites.
Cookies and beacons
Like many other websites, we use cookies to track and collect information about your use of our Services. “Cookies” are small data files and identifiers that we transfer to your computer or device that allow us to recognize your browser or device and tell us how and when pages in our Service are visited and by how many people. We link the information we store in cookies to the information you may have provided us while using the Site. We also use web beacons, tags and other means on our Site. Such beacons are an electronic file, sometimes only a pixel or small image, embedded on websites. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of our websites.
Links to third party websites
Our Sites and Services may implement links to the websites of our commercial partners and other third parties. If you choose to visit such websites, please take into account that we shall not be responsible for the practices employed by such websites linked to or from our Services, including the information or content contained thereinto. Third parties such as Google, Twitter and Facebook will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and Internet usage.
Please remember that when you use a link to go from a BBS Site or Services to another website, our Privacy Policy does not apply to those third-party websites or services. Your browsing is at your own and final risk.
Terms of Use Policies
Every portal that BBS operates has a specific ‘Terms of Use’ policy document that must be accepted before a user is allowed to operate and / or access the portal.
These Terms of Use documents specifically and comprehensively outline how the portal operates, the rights and responsibilities required and other general information that clearly outlines how private and confidential data is handled.
‘Terms of Use’ documents should be read in detail so that you understand the importance that BBS places on Privacy and Confidentiality.
